African Commission on Human and Peoples’ Rights adopts landmark General Comment on social services which includes GI-ESCR contribution

The African Commission on Human and Peoples' Rights adopted the General Comment on the Obligations of States to Regulate Private Actors Involved in the Provision of Social Services. The landmark text was adopted during the African Commission’s 72nd Private Ordinary Session held between July 19 – August 2, 2022. *It will be published in October.

This General Comment advances the most progressive interpretation of human rights law related to the provision of social services which are essential for the enjoyment of human rights, especially economic, social and cultural rights.

GI-ESCR played a critical role in supporting the development of this General Comment as a member of the Drafting Committee, alongside the Centre for Human Rights, the University of Pretoria; the Dullah Omar Institute, University of the Western Cape; the Initiative for Social and Economic Rights (ISER), and the Right to Education Initiative. The drafting process was led by the African Commission Working Group on Economic, Social and Cultural Rights.

The adoption of this General Comment followed extensive consultations, including a public consultation on the text in March 2022.
